PARAMOUNT RELEASED FROM LIABILITY OVER IRON MAN IP SUIT

On June 6, 2018, Paramount Pictures was dismissed from a copyright infringement suit that claimed they, along with Disney’s Marvel Entertainment and others involved in the making of Avenger films, copied designs in creating the armor used for Iron Man.

Horizon Comic Production Inc. agreed to drop its claim against Paramount after U.S. District Judge J. Paul Oetken cut out most of the case it had against the studio, leaving Horizon with almost nothing to pin against them. The judge dismissed claims that Marvel entities stole Horizon’s designs from Horizon’s own comic book series “Radix,” leaving only arguments that an “Iron Man 3” poster may infringe Radix’s design. However, Paramount had nothing to do with the poster, thus relieving Paramount of all remaining liability in the lawsuit.

Fact discovery and depositions for the remaining parties are scheduled to be completed later this month.

The case is Horizon Comics Productions Inc. v. Marvel Entertainment LLC et al., case number 1:16-cv-02499, in the U.S. District Court for the Southern District of New York.
