On February 28, 2019, an attorney labeled a “copyright troll” by a New York federal judge filed a copyright infringement lawsuit against Netflix over footage used in Netflix’s Fyre Festival documentary.
New York lawyer Richard Liebowitz, who has filed more than 700 lawsuits in the Southern District of New York since 2016, filed a complaint on behalf of Clarissa Cardenas (“Cardenas”) that claims Netflix’s film about the Fyre Festival used her footage without permission. The complaint included little detail, saying only that “Cardenas took video of the Frye Festival” and that the “defendants ran the video in the film.”
Fyre Festival, the failed music venture that was widely publicized in April 2017, has become the latest talked-about “failure” since both Netflix and rival Hulu released dueling documentaries in the same week in January 2019. The Netflix version, “Fyre,” has drawn criticism because it was produced by the same social media agency that promoted the failed festival. That agency, Jerry Media, was also named in this lawsuit.

Counsel information for the defendants, formally Netflix Studios LLC and Jerry Media LLC, was not immediately available.
The case is Cardenas v. Netflix Studios LLC et al., case number 1:19-cv-01937, in the U.S. District Court for the Southern District of New York.
